Terms of Service
Review the terms and conditions that apply when you use Attune and our software and consulting services. These terms govern your rights and obligations when engaging with Attune.
Scope of Services
Attune provides AI visibility software, analytics, and strategic consulting services to improve enterprise visibility across AI assistants and LLMs. Our services include brand memory audits, optimization recommendations, implementation support, and ongoing monitoring. All services are provided on an as-is basis and subject to the scope defined in your engagement agreement or statement of work.
Use of Our Services
You agree to use Attune's software and services only for lawful purposes and in compliance with all applicable laws and regulations. You will not use our services to circumvent AI assistant terms of service, engage in illegal activities, or create harmful content. You are responsible for maintaining the accuracy and legality of all information you provide to us.
Intellectual Property Rights
All software, methodologies, analytics frameworks, reports, and deliverables created by Attune remain the property of Attune unless otherwise defined in a written agreement. You retain ownership of your data and any derivative insights you develop internally. Licensed software is provided under a limited, non-exclusive license for your internal business use.
Confidentiality and Data Security
We treat all client information, including proprietary data, brand strategies, and business metrics, as strictly confidential. Confidential information will not be shared with third parties except as necessary to deliver services, when required by law, or when you provide explicit written consent. We implement industry-standard security measures to protect data from unauthorized access.
Payment Terms
Fees for services are outlined in your engagement agreement. Payment is generally due within thirty (30) days of invoice unless otherwise specified. Late payments may result in suspension of services. For consulting engagements, we bill based on agreed rates and time spent. Software subscriptions are billed according to your selected plan.
Warranties and Disclaimers
While we apply industry best practices in analyzing AI visibility, we cannot guarantee specific outcomes, rankings, or AI assistant responses due to the evolving nature of AI systems. Services are provided on an "as-is" basis. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. Our liability is limited to the extent permitted by law and to fees paid for services rendered.
Termination
Either party may terminate an engagement with written notice as specified in the engagement agreement. Upon termination, you remain responsible for all fees accrued through the termination date. We will provide a transition period for data access as required by contract. Sections on Intellectual Property, Confidentiality, and Limitations of Liability survive termination.
Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with the laws of the jurisdiction specified in your engagement agreement, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation between parties. If negotiation fails, disputes shall be resolved through binding arbitration or litigation as specified in your agreement.
